General Terms and Conditions of Sales

1) Object

These general conditions of sale apply between:

the Company Oxy Automation Srl (Italian Registred Office BO – R.E.A. 522296)

Registered office: Via G. Lazzari 5 – 40057 (BOLOGNA), Italia.

VAT NUMBER: IT03933131207. Hereinafter referred to as «Oxy»

and

all natural persons who can be defined as "Consumers" pursuant to art. 18 of the Consumer Code who visit and make a purchase on the website www.Oxy4us.com, hereinafter «User».

These conditions identify the general conditions to be applied to all orders sent by the User to Oxy, electronically, and to contracts, present and future, always stipulated electronically with the latter for the purchase of products on www.Oxy4us.com.

Specifically, the conditions govern all the phases aimed at the conclusion of the electronic contract and the events that may affect its subsequent conclusion.

Part of these conditions is also reserved for the regulation of the contents of the Oxy4us.com website and the rights, including intellectual property rights, on the same.

Access to and use of this website, as well as the purchase of products on it, are based on the assumption that these general conditions of sale have been read and understood.

The use of the website www.Oxy4us.com implies, on the part of the User, the implicit and irrevocable acceptance of these general conditions of sale.

This site is managed and maintained by Oxy Automation srl and any collaborators.

The general conditions may be subject to changes or additions over time, it is understood, however, that the conditions applicable to the sale will be those in effect on the date on which the order was placed by the user, on the site www.Oxy4us.com

The user declares to have the capacity to conclude this contract.

To purchase one or more products on the site www.Oxy4us.com you must proceed in advance to the creation of your customer profile giving your consent to the processing of your personal data.

The user will be responsible for any improper or unauthorized use of the site www.Oxy4us.com and its contents. Therefore Oxy Automation srl shall not be held responsible for any use of the site and its contents made by the User in violation of these conditions of applicable laws or regulations or otherwise not previously authorized by Oxy Automation srl in writing.

Furthermore, the User will be held liable for the communication of information or data that is incorrect, false or related to third parties (if the third parties have not given their consent), as well as for any improper use of such data or information.

2) Products

The products offered for sale by Oxy Automation slrs are those shown on the website www.Oxy4us.com on the day of consultation of the site by the user.

The characteristics of the products offered for sale are described with the greatest possible degree of precision. However, if errors or omissions should occur in the presentation of the products, these cannot be charged to Oxy Automation. In fact, the images and texts illustrating the products have a purely indicative value and have no contractual value.

3) Prices

Prices are indicated in euro/€, pound/£ and dollars/$ and include VAT for the private user, while VAT for the retail user is not included; shipping costs are the responsibility of the user unless they are expressly charged to Oxy Automation, the latter must be expressly authorized by Oxy Automation for each transaction.

The prices indicated take into account the VAT applied on the day the order is placed. If the rate applied is changed, these changes may affect the price of the items without the user being able to object to anything.

Oxy Automation srl reserves the right to change its prices at any time. The products will be invoiced on the basis of the rates in force on the site at the time the order is registered.

4) Order

By placing the order the user declares:

  • to have read and irrevocably accepted these general conditions of sale, the sending of the order therefore constitutes acceptance of the general conditions of sale, the Policy on the processing of personal data and the terms and conditions for withdrawal.

  • The customer expressly and irrevocably accepts the prices and descriptions of products available for sale, as identified on the website www.Oxy4us.com and has deemed them complete and exhaustive.

The order will not be definitively sent and registered by Oxy Automation except by sending and validating the payment of the order. Subsequently, the order is considered irrevocable and non-modifiable.

When the order is registered by the Oxy4us.com website, an email is sent to the User. This email represents the confirmation that the order has been taken over by Oxy Automation. During the promotion period and/or the sales period, Oxy Automation will process the orders received during the promotion or balance operation, while stocks last ("offer valid from... to... and while stocks last").

When an order is confirmed, Oxy Automation will send the User, in writing or by email (the contents of which must be stored on a durable medium), confirmation of purchase, summarizing the information relating to the order (essential characteristics of the products purchased, detailed information on price, payment terms).

5) Payment Method

The payment methods accepted by Oxy Automation are: debit to credit card (Visa, Mastercard) via Pay Pal or bank transfer.

Pay Pal (credit card): in the case of purchase of goods with Pay Pal payment method, the charge is made at the same time as the conclusion of the online transaction. The User authorizes Oxy Automation srl to debit his account and "unless successful" the amounts relating to the products purchased on the site by his credit card indicated.

Bank Transfer(remittance): the method of payment by bank transfer (in advance), requires that the order is processed only after payment by the user and receipt and availability of the bank transfer by Oxy Automation. The data to make the transfer are displayed on the site, are communicated in the order confirmation page and in the order confirmation e-mail sent to the user. The reason for the transfer must include: the order number, name and surname of the order holder.

In case of cancellation of the order by the User, Oxy Automation will proceed to refund by bank transfer or, alternatively, refund by Pay Pal. The contract (of sale) is intended with effects "unless successful", that is, with the reservation of Oxy Automation to terminate the contract of sale in the event that the credit of the payment is not made. In this case Oxy Automationwww.Oxy4us.com, pursuant to art. 1456 of the Italian Civil Code, may also terminate the relationship with the User by right by virtue of these conditions. The delivery note, invoice or receipt will be inserted in the package containing the product ordered and/or sent later also in electronic format.

The contract (of sale) is intended with effects "unless successful", i.e. with the reservation of Oxy Automation to terminate the contract of sale in the event that the credit of the payment is not made. In this case, Oxy Automation, pursuant to art. 1456 of the Italian Civil Code, will not be liable for any loss or damage caused by the use of the software. Italian, may also terminate the relationship with the User by right by virtue of these conditions.

The delivery note or transport document (DDT) will be inserted in the package containing the product ordered, the invoice or receipt / receipt, can be inserted in the package containing the product and / or sent later in paper format and / or electronic according to law (art. 1 Law 244/2007) The user will still have the opportunity, having previously requested the invoice on the order, to be able to print it directly from the site in the session "My orders".

The User authorizes Oxy Automation to debit his account and "unless successful" the amounts relating to the products purchased on the site by means of his credit card indicated.

6) Payment security

In order to guarantee the security of the payment, Oxy Automation srl uses the secure payment Pay Pal for the debit of credit cards, which adheres to the international standards of compliance PCI-DSS (Payment Card Industry Data Security Standards).

7) Shipping costs, terms and conditions of delivery

Except in cases of force majeure, the delivery terms will be those indicated below. Oxy Automation srl shall not be liable for any delay in delivery, for whatever reason, except by intent or gross negligence. It follows that no claim of any kind can be made by the User against Oxy Automation srl. In addition, Oxy Automation also offers the possibility to take out shipping insurance. Oxy Automation reserves the right to choose the carrier.

Shipping costs are to be borne by the User except in cases expressly authorized by Oxy Automation srl in writing (or even by e-mail).

Rates and delivery terms

Private and Reseller user

  • delivery in Italy, Calabria and the Islands Excluded: 24/48h.

  • delivery in Italy: Calabria, Sicily and Sardinia: 48/72h.

  • delivery Europe (European Union): 4/5 Working Days.

  • European delivery (Extra-European Union): 4/10 Working Days.

  • delivery outside Europe: odd cases.

  • for some countries Oxy Automation srl reserves the right to communicate different shipping rates, not due to the will of the same, but imposed by our courier.

Terms of delivery

Shipping in 48 hours if the goods are in stock, 10 working days if the goods are not in stock.

There may be delays in delivery not due to our responsibility but due to production delays by our suppliers, so Oxy Automation is not responsible for late delivery.

8) Returns and exchange rates

Pursuant to Legislative Decree no. 206 of 6 September 2005 (Consumer Code), in compliance with the provisions of art. 47 of the same decree, the User/Consumer is informed that he may freely exercise his right of withdrawal, stating precise and exact reasons, within 14 days from the day of receipt of the product purchased, pursuant to Articles 64 and 67 et seq. of the Consumer Code within the following terms:

  • change / replace the items purchased.

The reasons given for the return/exchange must be justified in writing and accepted by Oxy Automation srl.

After the above deadline, the delivered products will be considered definitively accepted by the User, therefore Oxy Automation reserves the right to refuse or accept from the User the relative change of products.

Each item must be returned including all original labels, packaging and accessories (whether sold as a single product or as a kit) received with the order.

In the event that the User receives defective goods, or in the event that shipping errors occur on the part of Oxy Automation, the User is required to follow the same instructions as above. Oxy Automation reserves the right to request digital photographic evidence before authorising returns of defective goods and to bear the shipping costs for the return of the goods to its premises.

Oxy Automation reserves the right to refuse unauthorized returns or returns that do not meet all conditions.

In such cases, the goods will be returned to the sender at the original shipping address and the shipping costs will be borne by the customer.

The User also has the option of replacing the product received with another item of equal or higher price.

The user may return the item only upon presentation of the purchase invoice or summary of the order received by e-mail.

9) Protection of personal data

The information relating to the processing of personal data is contained in the privacy policy which the user declares to have read and accepted the conditions at the time of signing the order.

All Users are invited to read the Privacy Policy that applies even if they decide to access the Oxy Automation website and use the services available on it without making purchases. The Privacy Policy clarifies the ways and purposes for which Oxy Automation collects and uses Users' personal data.

10) Intellectual property

All elements published on the Oxy Automation website, including but not limited to: trademarks, logos, models, distinctive signs, images and sounds, videos and music, menus, web pages, graphics, colors, schemes, tools, fonts, site design, diagrams, layouts, methods, processes, functions are protected by copyright and trademark law and all other intellectual property rights of Oxy Automation.

These are the exclusive property of Oxy Automation, which may therefore take any legal action against those who, directly or indirectly, violate its intellectual property rights. The use or reproduction, even partial, of any element contained in the site is prohibited.

11) Content Disclaimer

Oxy Automation undertakes to prevent the publication on the websites www.Oxy4us.com and www.Oxyautomation.com of contents that describe or represent situations of physical or psychological violence or that, according to the sensitivity of the users, could be considered a violation of convictions or civil rights and/or a violation of dignity, in all its forms and expressions.

In any case, Oxy Automation cannot guarantee that such content is appropriate or lawful in countries outside of Italy.

If such content is to be considered illegal or illegal in some of these countries, the User is advised not to access the site www.Oxy4us.com.

By accessing the site and using the services provided by Oxy Automation, the User shall be solely and personally liable.

Oxy Automation takes measures to ensure that the content of the site is accurate, current and verified as far as possible.

12) Liability

Oxy Automation assumes, at all stages of contact with the User: from access to the site, to the order process, to shipping or after-sales services, an obligation of means. Therefore, Oxy Automation cannot be held responsible for any inconvenience or damage inherent in or resulting from the use of the Internet, by way of example only and not limited to: an interruption of the service, an external intrusion, the presence of computer viruses or facts qualifying as force majeure in accordance with case law.

Furthermore, Oxy Automation cannot be held liable for any breach of its contractual obligations in the event of a fortuitous event or force majeure, including, but not limited to, strike, fire, catastrophe, breakdown and in general any event that prevents the proper execution of orders.

13) Warranty

With regard to defective products, the user can make use of the regulations relating to them by returning the product under the terms of these conditions.

Oxy Automation reserves the right to assess the existence or otherwise of such defects and, if so, to replace the defective product.

14) Integrity

In the event that any of the clauses of this contract is declared null and void by a legislative or judicial change, this will not affect the validity of and compliance with these general conditions of sale.

15) Duration

These conditions shall apply during the entire duration of the online provision of the services offered by Oxy Automation. The general terms and conditions of sale may be updated to comply with new laws or regulations or for internal reasons of the company. The new terms and conditions will be effective as of the date of publication on www.Oxy4us.com.

16) Applicable law and protection of rights

These general terms and conditions of sale are governed by Italian law and in particular by the Legislative Decree of 6 September 2005, n.206 on distance contracts and the Legislative Decree of 9 April 2003, n.70 for aspects relating to electronic commerce.

In case of disagreement, the parties undertake to try to resolve any disputes out of court.

17 ) Retention of title

All products are subject to retention of title in favour of Oxy Automation until full payment of the price.

I declare that I have read and accept the conditions of sale.

Pursuant to and for the purposes of articles 1341 and 1342 of the Italian Civil Code, the User expressly accepts the contents of articles 2, 3, 4, 8, 9, 13, 14, 17 of these general conditions of sale.
